TeachHero, Inc.

These Terms of Service ("Terms") govern your access to and use of the TeachHero platform (“Service”), provided by TeachHero, Inc. ("TeachHero", "we", "our", or "us"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using TeachHero, you confirm that:

• You are at least 18 years old or have legal authority to enter into these Terms.
• If you are creating or managing a school account, you have the authority to act on behalf of your school or organization.
• You agree to comply with all applicable laws and regulations.

2. Schools, Families, and Invited Users

TeachHero is used by two groups: schools — the organizations that create an account, subscribe, and decide how the platform is used — and invited users — the parents, guardians, teachers, and staff a school invites into its portal and panels. These Terms apply to both.

If you are a parent, guardian, teacher, or staff member using TeachHero through a school, your enrollment, tuition, employment, and school policies are matters between you and that school. TeachHero provides the software the school uses to manage them.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You agree not to share your login credentials or give access to unauthorized users.

4. Permitted Use

You agree to use TeachHero only for lawful and educational purposes. You may not:

• Use the Service to violate any law or regulation
• Interfere with or disrupt the Service or servers
• Access data not intended for you
• Attempt to gain unauthorized access to accounts or systems
• Use the Service to send spam, malware, or offensive content

Your use of the Service is also governed by our Acceptable Use Policy.

5. Plans, Subscriptions & Billing

• TeachHero offers a free plan and paid subscription plans. Current plans, prices, included features, and add-ons are published on our pricing page. By subscribing, you agree to pay all applicable fees.
• Standard subscriptions are billed monthly and can be cancelled at any time from within the app — there are no long-term contracts or cancellation fees. Scale plans are annual and governed by a separate written agreement; if that agreement conflicts with these Terms, the agreement controls.
• Subscription payments are securely processed by Stripe.
• 30-day money-back guarantee: if you are not satisfied with a new paid subscription, contact us within 30 days of your first subscription payment for a full refund of subscription fees.
• Outside the 30-day guarantee, all fees are non-refundable unless otherwise stated. Payment processing fees on transactions are not refundable.
• We reserve the right to change pricing with advance notice.

6. Payments Between Families and Schools

• When a school collects tuition and fees online through TeachHero, payments are processed by Stripe through the school's own Stripe account. The school — not TeachHero — is the merchant and seller of its programs and services, and is responsible for its offerings, enrollment decisions, and refund policies.
• TeachHero charges the school payment processing fees on these transactions at the rates published on our pricing page. TeachHero is not a party to the transaction between a family and a school; refund requests for tuition and fees should go to the school first.
• Payment details are collected directly by Stripe. TeachHero never stores full card or bank account numbers.
• When a family authorizes automatic payments — autopay or an installment plan — the authorization is captured at checkout. A family can stop autopay by removing its stored payment method in the portal or by contacting the school.
• Where permitted by law and card network rules, a school may choose to pass payment processing fees on to families at checkout. TeachHero disables this option in jurisdictions where we understand it to be prohibited, but each school remains responsible for confirming that passing on fees is lawful where it operates.

7. Your School's Data

• The data a school enters or collects through TeachHero — student records, family contacts, forms, and financial history — belongs to the school. You can export your data at any time.
• We use this data only to provide and improve the Service, and we never sell it.
• If you close your account, we retain your data for 30 days and then delete it.

8. Student Information and Required Consents

Schools decide what information to collect from families and students through TeachHero. Each school is responsible for providing any notices and obtaining any consents required by the laws that apply to it — including FERPA and COPPA where applicable — before collecting information about students, and for using that information consistently with its own policies.

9. Intellectual Property

The TeachHero platform — its software, design, and the content we provide — is owned by TeachHero, Inc. or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without written permission.

Content you or your school submit — school websites, documents, photos, and form responses — remains yours. You grant us the license needed to host, display, and transmit that content in order to operate the Service.

10. Privacy

Our use of your information is governed by our Privacy Policy, which describes what we collect, the service providers we rely on, and the choices you have.

11. Text Messaging (SMS)

Where a school enables text messaging, TeachHero sends SMS messages to mobile numbers provided by families and staff, on behalf of that school. These messages fall into two categories:

• Transactional messages — such as sign-in codes and emergency alerts — sent as part of operating the Service.
• Optional (non-emergency) messages — such as school announcements and volunteer requests — sent only to recipients who have opted in.

By providing a mobile number and opting in, you agree to receive text messages from the school via TeachHero at that number. Consent to receive optional messages is not a condition of enrollment, purchase, or use of the Service. Message frequency varies, and message and data rates may apply. Reply STOP to any message to opt out of further messages, or HELP for help; you can also manage optional-message preferences in your school's parent portal. Mobile carriers are not liable for delayed or undelivered messages.

12. Termination

• We may suspend or terminate your account if you violate these Terms, fail to pay fees when due, or if we are required by law to do so.
• You may terminate your account at any time via the TeachHero app. Export your data before you close the account; after termination, we retain your data for 30 days and then delete it, as described in Section 7.

13. Disclaimers

TeachHero is provided “as is” and “as available.” We do not guarantee that the Service will be error-free, uninterrupted, or secure. To the fullest extent permitted by law, we disclaim all warranties.

Our support hours and response-time targets are described on our Support SLA page. They are service goals, not warranties.

14. Limitation of Liability

To the maximum extent permitted by law, TeachHero, Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability will not exceed the amount you have paid in the 12 months prior to the claim.

15. Indemnification

You agree to indemnify and hold harmless TeachHero, Inc. from claims arising out of content you submit, your use of the Service in violation of these Terms or applicable law, or — if you are a school — your relationships with your families, students, and staff, including enrollment, tuition, and refund disputes.

16. Modifications to the Service

We may modify or discontinue any part of the Service at any time. We will notify users of significant changes in advance.

17. Changes to These Terms

We may update these Terms from time to time. If we do, we will notify you by email and update the “Effective Date” at the top. Continued use of the Service after updates means you accept the new Terms.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
